About this course
Civil Litigation takes a dispute from the first client interview to the enforcement of a judgment. It is built on the Civil Procedure Act (Cap 21), the Civil Procedure Rules, 2010, the Magistrates’ Courts Act, 2015 and the Evidence Act, read with Article 159 of the Constitution and the overriding objective in sections 1A and 1B of the Act.
The unit follows the life of a suit in four stages: choosing the right court and parties and starting the suit; pleadings, judgment without trial and interlocutory relief such as injunctions; the pre-trial process, the hearing, evidence and judgment; and what happens after judgment, from execution and stay to review and appeal. Throughout, the emphasis is on the practical step: which document, under which order and rule, in which court and by when.
Examiners test jurisdiction, injunctions, default and summary judgment, stays of execution and appeal deadlines in almost every sitting, usually through a set of facts that asks you to advise and then draft.
