About this course

Probate and Administration covers what happens to a person’s property on death: making a valid will, distribution on intestacy, obtaining and confirming a grant of representation, and the duties of the personal representatives who administer the estate. The governing law is the Law of Succession Act (Cap 160) and the Probate and Administration Rules, read with Articles 27, 45 and 170 of the Constitution.

The unit covers the scope of the Act, including the position of Muslims and gazetted agricultural land; capacity and the formalities for wills; provision for dependants; the intestacy rules for monogamous and polygamous estates; the types of grant, priority to apply, objections, caveats and confirmation; and the duties of administrators, intermeddling and revocation of grants.

This unit had a 30.5 per cent pass rate in April 2026. Almost every question can be answered from about twenty sections of the Act, and the unit states each of them by number.
