About this course
Conveyancing is the law and practice of transferring and dealing with interests in land in Kenya. It is governed by Chapter Five of the Constitution, the Land Act, 2012, the Land Registration Act, 2012, the Land Control Act (Cap 302), the Law of Contract Act, the Matrimonial Property Act, 2013 and the Stamp Duty Act (Cap 480).
The unit follows a transaction from start to finish: the sale agreement and its formalities; investigation of title, searches and overriding interests; completion, stamp duty and registration, including electronic registration; and charges, leases, easements and sectional titles. It gives particular attention to the risks that most often defeat a buyer or a lender: missing Land Control Board consent, absent spousal consent, cautions, customary trusts and defective statutory notices.
Questions usually combine advice on a transaction with a drafting task, such as a sale agreement clause, a professional undertaking or a report on title.
